DANIEL B. FITZGERALD is an associate of Brody Wilkinson and a member of the firm’s Business and Dispute Resolution Groups. His practice is focused in the areas of business law, employment law, administrative law, sports law, trademark law and commercial disputes. Mr. Fitzgerald’s business practice includes reviewing, drafting and negotiating contracts, advising on trademark applications and protection issues and managing employment matters for a diverse base of clients. Mr. Fitzgerald is an experienced litigator, representing clients before the Connecticut Superior Courts, Connecticut Appellate Court, U.S. District Court, U.S. Bankruptcy Court and Statewide Grievance Committee in various matters. He also represents clients in administrative proceedings and appeals, including public and private education proceedings and property tax appeals.
Mr. Fitzgerald frequently provides counsel to clients concerning legal issues that arise in amateur, collegiate and professional athletics. He serves as general counsel to a minor league hockey team in Connecticut and frequently assists student-athletes and their families with eligibility and transfer matters involving the Connecticut Interscholastic Athletic Conference (CIAC) and National Collegiate Athletic Association (NCAA). In addition, he provides trademark counsel to the charitable foundation of a professional athlete and often represents health and fitness clubs in connection with liability issues.
An avid writer, Mr. Fitzgerald is the publisher of Connecticut Sports Law (www.ctsportslaw.com), Connecticut’s first blog covering the intersection of sports and the law. In addition, several of his articles have been featured in leading sports law publications, including Legal Issues in Collegiate Athletics, Legal Issues in High School Athletics and Sports Litigation Alert. He teaches sports law as an adjunct professor at Quinnipiac Law School and has lectured at Harvard Law School, St. John’s University and Drexel University. Mr. Fitzgerald also provides insight to the media on legal issues in the sports arena, appearing on ESPN Radio, WTNH Channel 8, and WSTC 1400 Norwalk, and has been interviewed for articles published in Sports Business Journal, the Hartford Courant and the Connecticut Post.
He is admitted to practice in Connecticut and the U.S. District Court, District of Connecticut. Mr. Fitzgerald is a member of the Connecticut Bar Association and is the former chair of its Sports & Entertainment Law Section. He is also a member of the Sports Lawyers Association. Mr. Fitzgerald has been recognized by Super Lawyers Magazine and Connecticut Magazine as a “Rising Star” in the area of Sports and Entertainment Law since 2010. Prior to joining Brody Wilkinson, Mr. Fitzgerald practiced for five years at the Connecticut-based law firm of Updike, Kelly & Spellacy, P.C.
Mr. Fitzgerald received his J.D. in 2005 from the University of Connecticut School of Law, where he was an associate editor of the Connecticut Insurance Law Journal. He received his B.A., cum laude, in 1999 from Fairfield University. Mr. Fitzgerald serves on the Board of Directors of the Fairfield Chamber of Commerce.
